All such content is protected by United States and international copyright, trademark, and other intellectual property laws.</p>

<p>Purchase of a physical product from this Site grants you ownership of that physical item only. It does not transfer copyright, reproduction rights, or any other intellectual property rights in the underlying design or artwork.</p>

<p>“Kahana Designs,” the Kahana Designs logo, and related product names are trademarks of Kahana Designs LLC. All other trademarks, service marks, product names, and brand names referenced on the Site are the property of their respective owners and are used for identification purposes only. Their use does not imply endorsement or affiliation.</p>
<h2>4. Cultural & Hawaiian Elements</h2>
<p>Many of our products draw on Hawaiian themes, imagery, and traditional craft forms — including but not limited to lauhala weaving, depictions of Hawaiian akua (deities) such as Pele and Poʻliahu, sacred places, and native flora and fauna. We approach this work with deep respect for Hawaiian culture and aim to honor the traditions from which it draws.</p>
<p>Our use of these themes is intended as a celebration of Hawaiian heritage and does not claim to represent any official endorsement by any Hawaiian cultural organization, kupuna, or governing body. <h2>5. Product Disclaimers</h2>
<h3>5.1 Original Artwork & Canvas Prints</h3>
<p>Our art prints are reproductions of original digital oil paintings, professionally produced on canvas or comparable media. Colors and tones may vary slightly between what you see on a screen and the final printed piece due to differences in monitor calibration, printer profiles, and material characteristics. Each piece is made to order; minor variations between individual prints are normal and not considered defects.</p>
<h3>5.2 Handmade Lauhala & Shell Jewelry</h3>
<p>Our jewelry is handmade using natural materials — including lauhala (pandanus leaf), shells, and other natural elements. Because no two pieces are identical, you should expect slight variation in color, texture, shape, weave pattern, and shell markings from piece to piece. These variations are inherent to handcrafted, natural-material work and are part of what makes each item unique.</p>
<p><strong>Allergen and material notice:</strong> Some jewelry may contain natural plant fibers, shell, metal findings, glue, or finishes that could cause irritation or allergic reactions in sensitive individuals. If you have known allergies or sensitivities, please contact us before purchasing. Discontinue wear if irritation occurs.</p>
<h3>5.3 Apparel & Clothing</h3>
<p>Our clothing is printed on demand by third-party production partners. Slight variations in print placement, color shade, and fabric weight may occur between individual garments. Sizing may vary by garment style; please consult the size guide on each product page before ordering. Garment fit, shrinkage, and wear characteristics depend on the underlying blank chosen by the production partner and may differ from one product to another.</p>
<h2>6. Site Content & Accuracy</h2>
<p>We make reasonable efforts to ensure that information on the Site — including product descriptions, prices, availability, and cultural background — is accurate and up to date. However, we do not warrant that the Site is error-free. Prices, descriptions, and product availability are subject to change without notice. In the event of a pricing error, we reserve the right to cancel any affected orders and refund payment.</p>
<p>Cultural and historical content provided alongside products is offered for general interest and is not intended as scholarly, religious, or definitive cultural instruction.</p>
<h2>7. Shipping Coverage</h2>
<p>Kahana Designs LLC currently ships to addresses within the United States only. Orders to addresses outside the United States are not accepted at this time. See our <a href="/policies/shipping-policy">Shipping Policy</a> for production and transit-time details.</p>
<h2>8. Third-Party Links & Services</h2>
<p>The Site may contain links to, or integrations with, third-party websites, applications, or services (including but not limited to Shopify, Printful, payment processors, shipping carriers, and social media platforms). We are not responsible for the content, privacy practices, or actions of any third-party site or service, and we do not endorse them by virtue of linking to them or using them in our operations.</p>

<p>To the maximum extent permitted by applicable law, the Site and all products and content offered through it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. <p>To the maximum extent permitted by applicable law, Kahana Designs LLC, its owners, members, managers, employees, contractors, suppliers, and production partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost data, loss of goodwill, business interruption, or personal injury — arising out of or related to your use of the Site or any product purchased through it, even if we have been advised of the possibility of such damages.</p>
<p>In any event, our total cumulative liability arising out of or related to any product or use of the Site shall not exceed the amount you actually paid to us for the specific product giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.</p>
<p>Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so portions of this section may not apply to you.</p>
<h2>11. Indemnification</h2>
<p>You agree to indemnify, defend, and hold harmless Kahana Designs LLC and its owners, members, managers, employees, contractors, suppliers, and production partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Site or any product; (b) your violation of this Legal Notice or any applicable law; or (c) your infringement of any third party’s rights.</p>
<h2>12. Governing Law & Jurisdiction</h2>
<p>This Legal Notice and any dispute arising out of or related to it or to the Site shall be governed by the laws of the State of Hawaiʻi, United States, without regard to conflict-of-laws principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in the County of Hawaiʻi, State of Hawaiʻi, and you consent to the personal jurisdiction of those courts.</p>
<h2>13. Severability</h2>
<p>If any provision of this Legal Notice is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or, if it cannot be made enforceable, severed from this Legal Notice. All other provisions shall remain in full force and effect.</p>
